Welcome to SocialSpy. By using our service, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using SocialSpy ("Service"), you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

SocialSpy is an AI-powered social media content generation and management platform. We provide tools to:

• Generate social media posts using artificial intelligence
• Schedule and manage content calendars
• Connect to and publish on social media platforms
• Analyze your business to create relevant content

3. Account Registration

To use the Service, you must create an account by providing a valid email address. You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

You must be at least 18 years old to use this Service. By using the Service, you represent that you meet this requirement.

4. Acceptable Use

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Generate or distribute harmful, offensive, or misleading content
• Spam, harass, or deceive others
• Interfere with the Service's operation
• Attempt to gain unauthorized access to any systems
• Use automated tools to abuse our API or rate limits
• Resell access without authorization

5. AI-Generated Content

Content generated by our AI is provided "as-is." While we strive for quality:

• You are solely responsible for reviewing and approving all content before publishing
• AI-generated content may contain errors or inaccuracies
• You should verify claims, especially about promotions, pricing, or health/safety topics
• We do not guarantee that generated content will achieve any specific results

You retain ownership of prompts you provide and content you create using the Service. You grant us a license to use this content to provide and improve the Service.

6. Third-Party Platform Terms

When you connect social media accounts (Instagram, Facebook, etc.), you must also comply with their respective terms of service:

• Instagram Terms of Use

We are not responsible for any actions taken by these platforms, including account suspension or content removal.

7. Social Media Account Access & Permissions

OAuth Authorization

To publish content on your behalf, we require you to authorize SocialSpy through Meta's official OAuth flow. By connecting your accounts, you grant us permission to:

• Access basic profile information (username, account ID)
• View Facebook Pages you manage
• Publish posts to your connected Instagram and Facebook accounts
• Read basic engagement data on posts we publish

Data We Access

When you connect social accounts, we access only the data necessary to provide our service. We do NOT access your private messages, friend lists, personal timeline content, or data from accounts you haven't explicitly connected. See our Privacy Policy for full details on data handling.

Your Control Over Access

You maintain full control over your social media account connections:

• You can disconnect accounts at any time via Settings → Connected Accounts
• You can revoke access directly through Instagram or Facebook settings
• We only publish content that you explicitly approve
• Disconnecting immediately revokes our access tokens

Revocation Process

To revoke SocialSpy's access to your social accounts:

1. In SocialSpy: Go to Settings → Connected Accounts → Disconnect
2. In Instagram: Settings → Apps and Websites → Active → Remove SocialSpy
3. In Facebook: Settings → Apps and Websites → Remove SocialSpy

Upon revocation, we delete your access tokens immediately. Content already published to your accounts remains there until you delete it directly on the platform.

8. Subscription and Payment

Free Tier

We offer a limited free tier with restrictions on the number of posts and features. Free tier availability may change at our discretion.

Paid Subscriptions

• Paid plans are billed monthly or annually
• Prices are subject to change with 30 days notice
• Refunds are provided at our discretion
• You may cancel at any time; service continues until the end of the billing period

9. Intellectual Property

The Service, including its design, features, and code, is owned by SocialSpy. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

Content you create using the Service belongs to you. However, you grant us a non-exclusive license to use, display, and process this content to provide the Service.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

11. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not responsible for any loss of business, revenue, or data

12. Indemnification

You agree to indemnify and hold harmless SocialSpy and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Content you create or publish
• Your violation of these Terms
• Your violation of any third-party rights

13. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform maintenance with or without notice
• Modify or discontinue features
• Suspend accounts that violate these Terms

14. Termination

You may terminate your account at any time through the Service settings. We may terminate or suspend your account immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the Service or other users

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.

15. Dispute Resolution

Any disputes arising from these Terms shall be resolved through:

1. Good faith negotiation between the parties
2. If negotiation fails, binding arbitration in accordance with applicable laws

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SocialSpy regarding the Service.
